1The Transitional Application TR-0092-09 was filed on February 11, 2009 under section 53(5) of the Ontario Human Rights Code, R.S.O. 1990, c.H.19, as amended (the “Code”). A hearing commenced on February 24, 2010 on the Transitional Application. Upon the agreement of the parties, I adjourned the hearing for the purpose of joining the Transitional Application with Application 2010-04742-I which was filed in February 2010 under s. 34 of the Code.

2The parties agree, and I find that the Transitional Application and the section 34 Application relate to an ongoing series of events from October 2007 until January 2010, such that it would be more fair, just and expeditious to hear the evidence relating to both Applications together.

3Also on agreement of the parties, I began mediation with the parties to resolve both Applications. The parties have agreed to continue the mediation via teleconference.

4The mediator will be in touch with the parties in due course.
