1This is an Application filed on February 2, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code").

2Having regard to the consent of the parties, the Tribunal defers the Application pending the completion of grievance proceedings.

3The hearing scheduled in this matter for April 19, 20, 21, May 3 and 4, 2010 is accordingly cancelled.

4The Tribunal directs the parties' attention to Rules 14.3 and 14.4 which outline the procedure by which the Application may be brought back on after the conclusion of the grievance process. The outstanding Requests for Orders as well as the union's Request to Intervene will be dealt with by the Tribunal if the Application is brought back on.
