1This is an Application filed on October 2, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2By Interim Decision dated January 19, 2010, 2010 HRTO 122, the Tribunal directed the applicant to re-state her allegations, before proceeding with the Application.
3The Tribunal stated that it would consider the applicant’s submissions before deciding whether to dismiss or proceed with all or part of the Application. Further, the Tribunal stated that if the applicant did not file written submissions by the required time the Tribunal may make its decision based on the material before it, or may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not filed submissions and the time for doing so has elapsed. In the circumstances, the Application is deemed abandoned and it is dismissed.
