Michael Kovacs v. CIM Metals Inc., 2010 HRTO 418

1This is an Application filed December 11, 2008 under section 53(3) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). A Case Resolution Conference (“hearing”) is scheduled for March 23, 2010. The purpose of this Interim Decision is to address the respondents’ refusal to provide copies documents ordered disclosed to the applicant.

2In an earlier Interim Decision, 2010 HRTO 304, I ordered the respondent to produce its 2005, 2006 and 2007 corporate tax returns. The respondent has filed the material with the Tribunal but declines to provide a copy to the applicant because the applicant has not agreed to pay the cost of photocopying.

3The respondent is directed to immediately provide copies of the 2005, 2006 and 2007 corporate tax returns to the applicant. Parties are generally expected to bear the cost of providing copies of arguably relevant documents to other parties and the Tribunal and this case is no exception.
