1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on June 12, 2009 and the respondent filed a Response on August 4, 2009. Both parties indicated that they agreed to attend mediation and a mediation session was scheduled for March 1, 2010. The respondent advised that the personal respondent would not be available on that date and asked that the mediation be rescheduled. The Tribunal attempted to reach the applicant by telephone to canvass dates. The Tribunal’s calls were not returned. By letter dated December 8, 2009, the Tribunal advised the applicant that if he did not respond within 10 days of the date of the letter, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence or telephone calls.
2In the circumstances, the applicant is deemed to have abandoned the Application.
3The Application is dismissed.
