1On February 17, 2010, the Tribunal issued an Interim Decision noting that a Response had not been received within the time allowed in the Rules and directing the respondent to file a Response within a specified time.
2That Interim Decision was based on an understanding that the respondent had not filed a Response within 35 days of December 14, 2009, as required by the Tribunal’s Rules.
3Subsequently, it was discovered that the respondent had in fact filed a Response and a Request for Early Dismissal on January 15, 2010. Through an administrative error on the part of the Tribunal, the Response and Request were not placed on the file.
4In the circumstances, it is appropriate for the Tribunal to reconsider the February 17, 2009 Interim Decision on its own motion, and it is accordingly revoked. It will not be posted to the public reporter services.
5The Response and Request for Early Dismissal filed by the respondent will be sent to the applicant and the matter will proceed in accordance with the Tribunal’s Rules.
6I am not seized of this matter.
