1This is an Application filed September 14, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code"). The applicant alleges discrimination in employment on the basis of disability.
2Attached to the Application are copies of two Records of Employment from his former employer, Cando Rail Services Ltd., that suggest that the applicant's employment ended for reasons related to his medical condition. The documents originate from the company's offices in Brandon, Manitoba.
3On October 20, 2009, the Tribunal sent the applicant a Notice of Intent to Dismiss because the respondent appeared to be a federally regulated business. The letter directed the applicant to file written submissions within 30 days to explain why he believes the Application is within the Tribunal's jurisdiction.
4The applicant has not responded to the October 20, 2009 letter.
5The applicant is directed to file written submissions on the issue of the Tribunal's jurisdiction to deal with this Application within 30 days of this Interim Decision, failing which the Application will be dismissed as abandoned.
6I am not seized.
