1These are two Applications filed June 25, 2009 under section 53(5) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). Mediation is scheduled for March 4, 2010. The applicant has filed a Request for Order during Proceedings seeking production of documents.

2The Tribunal's Rules contemplate that mediation is conducted prior to the exchange of documents between the parties. If mediation does not resolve the issues between the parties, the parties have the opportunity, during the case management portion of the meeting, to discuss the types of documents they are seeking. If they cannot agree, the applicant may file a Request for Order at that time.

3The request for order is dismissed as premature.
