1This is an Application filed March 25, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code"). The Application alleges discrimination in employment and reprisal on the basis of sex. The purpose of this Interim Decision is to address the applicant's Request for an Order during Proceedings seeking production.
2Mediation is scheduled for February 25, 2010 and the hearing is scheduled for April 13, 2010.
3The applicant seeks the complete contents of any personnel, contract or human rights files from any of the respondents. The basis of the result is that the respondents have submitted some email chains that she asserts, when considered out of context, have nothing to do with her human rights claims and are an attempt to make her look bad.
4The respondents state that they have already produced the applicant's contract file, the investigation report, and harassment file.
5It is unclear to me what else the applicant is seeking. The respondents' have an obligation to disclose all arguably relevant documents in the applicant's employment/contract file and the file relating to the harassment allegations. They assert that they have done so.
6If the applicant is aware of specific documents that ought to be disclosed she must specify what they are, in sufficient detail to permit the respondents to respond and the Tribunal to determine whether the requested material should be disclosed.
