1The applicant filed an Application on July 20, 2009, under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging reprisal and discrimination in employment on the basis of race, colour, disability, family status and age.
2The respondents have all filed Responses and the parties have attempted mediation, which did not result in a settlement of the Application. The matter is now proceeding to a hearing.
3On October 20, 2010, the applicant’s representative filed a Request for Order During Proceedings (Form 10) seeking to amend the grounds of discrimination to disability only. Additionally, the applicant filed a Request to Withdraw an Application (Form 9) as against some of the respondents.
4None of the respondents have filed submissions in relation to these requests.
5In view of the above, the applicant’s requests are granted.
ORDER
6The grounds of race, colour, family status and age shall be struck from the Application.
7The respondents Ontario Public Service Employees’ Union, Nicole Burke and Shane Hubert are removed from the Application and are no longer parties to this matter. The style of cause is amended to reflect their removal.
