1This is an Application filed on April 9, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2On July 6, 2010, the Tribunal issued a Notice of Intent to Dismiss to the applicant. It stated that it appeared the Application was outside of the Tribunal’s jurisdiction and directed the applicant to provide submissions responding to the issue raised in the Notice. The Notice advised the applicant that if he did not make submissions within 30 days from July 6, 2010, the Tribunal would make its decision based only on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason. The Notice was sent to the person identified as the applicant’s representative in the Application at the new address provided by the applicant’s representative by telephone call on June 30, 2010.

3The applicant has not provided any submissions and the time for doing so has elapsed.

4In the circumstances, the Tribunal deems the Application abandoned and it is accordingly dismissed.
