1The applicant filed an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended on October 27, 2009 alleging discrimination in employment on the basis of various grounds. The named respondents were Shopmen’s Local Union No. 834 of the International Association of Bridge, Structural, Ornamental and Reinforcing Iron Workers (the “Union”) and Joan Lilley.
2In an earlier Interim Decision, 2010 HRTO 2262, the Tribunal ordered the removal of the Union as a respondent to the Application.
3At the hearing into this matter on December 2, 2010, the applicant put in his evidence-in-chief. Following that the applicant advised that he wished to withdraw the Application as against the remaining respondent, Joan Lilley. The respondent indicated that she was not opposed to the applicant’s request. In the circumstances, the Tribunal grants the applicant’s request to withdraw the Application.
4The Application is withdrawn with leave of the Tribunal.
