INTERIM DECISION
Adjudicator: Mary Truemner Date: December 23, 2010 Citation: 2010 HRTO 2536 Indexed as: Pitts v. South Simcoe Police Services Board
1This Interim Decision addresses an adjournment request by the applicant. The hearing is scheduled for January 27, 28 and 31, 2011.
2The reason for the request is that the applicant is ill. His request is accompanied by a letter from his doctor who confirms that his illness will not allow him to attend the hearing. The respondents consent to the adjournment.
3The Tribunal’s Information Bulletin on Scheduling of Hearings and Mediations, Rescheduling Requests, and Requests for Adjournments states that the Tribunal will only grant adjournments in extraordinary circumstances such as illness of a party, witness or representative. Given the exceptional circumstances of this case, I grant the request to adjourn.
4The applicant is eager to proceed as soon as he is well, and has suggested that the parties confer with each other by February 28, 2011 about rescheduling the hearing. The applicant, then, must notify the Tribunal by February 28, 2011 with dates when all the parties are not available for a hearing in the months of March, April and May.
5The applicant has not yet complied with the Tribunal’s Rules of Procedure with respect to documents intended to be used at the hearing and with respect to witnesses. But, in these particular circumstances, the deadlines under Rules 16 and 17 are extended until 45 days prior to the rescheduled hearing dates.
6I am not seized.
Dated at Toronto, this 23rd day of December, 2010.
