1This is an Application filed on October 8, 2010 under section 45.9 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), alleging contravention of a settlement.
2The applicant indicated that he sent the Application to the respondents as required by the Tribunal’s Rules, but provided no contact information for them. None of the respondents filed a Response. In an Interim Decision dated November 4, 2010, the Tribunal directed the corporate respondent and Bruce Black to file a Response if they wished to participate in the proceedings. The Tribunal asked the applicant to provide written submissions on why Robert Campbell was a proper respondent, and to immediately provide the Tribunal with the address and contact information for all respondents, or confirm that it was the same as that indicated in the Tribunal’s correspondence.
3The Tribunal sent the Interim Decision to the respondents at the address in the previous section 34 Application. Its correspondence has been returned marked as “Out of Business”. The Tribunal then sent a letter to the applicant on November 19, directing his attention to Rule 6.6(a) and (b) of the Tribunal’s Rules which state, among other things, that an Application will not be dealt with in respect of a respondent who cannot be contacted at an address provided in the Application. The Tribunal requested that the applicant provide current addresses for the respondents, or reasons why the addresses in the Tribunal’s files are in fact current.
4The Tribunal stated that failure to provide the information requested may lead to dismissal of the Application
5The applicant has not responded either to the Interim Decision or the Tribunal’s letter. In the circumstances, the Application is dismissed as abandoned.
