DECISION
Adjudicator: Kathleen Martin
Indexed as: Parsons v. Hide-A-Way General Store
1This is an Application filed on July 9, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").
2On June 10, 2010, a mediation was scheduled for October 20, 2010 in Sarnia. The notice of mediation was sent to the applicant's counsel at the time. On August 3, 2010, the Tribunal received a letter from the Human Rights Legal Support Centre advising that they were now acting for the applicant and that all further correspondence should be directed to counsel at the Centre. On October 19, 2010, the Tribunal was advised that the Human Rights Legal Support Centre was no longer representing the applicant and that they would therefore not be in attendance at the mediation.
3On October 20, 2010, no parties attended the mediation.
4On November 17, 2010, the Registrar of the Tribunal wrote to the parties directing that they advise the Tribunal of their intentions with respect to the Application. In addition, the Registrar stated that if there was no response within ten days of the date of this letter in writing, "the Tribunal will deem you to have abandoned the Application and close the file". The letter was addressed to the applicant at the address provided on the Application.
5There has been no response to the Tribunal's letter or any other communication from the applicant about this Application and the time for responding has elapsed.
6Having regard to the foregoing and the absence of any submissions from the applicant, I find that the applicant has abandoned her Application. The Application is therefore dismissed.
Dated at Toronto, this 14th day of December, 2010.
