1The applicant filed an Application on June 29, 2010 under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The Application was served on the respondents and the applicant’s association, Brockville Professional Firefighters’ Association (“Association”), as a named affected party.
3The Association filed a Request to Intervene on September 27, 2010.
4The organizational respondent and the individual respondent filed Responses on October 13, 2010 and October 20, 2010, respectively. The organizational respondent requested that the Tribunal defer the Application pending the conclusion of the applicant’s grievance.
5On December 1, 2010, the applicant filed a Reply which indicates that grievance has been withdrawn.
REQUEST TO DEFER
6In light of the fact that grievance has been withdrawn, deferral is not appropriate in the circumstances.
REQUEST TO INTERVENE
7The applicant’s Association seeks to intervene in accordance with Rules 11 of the Tribunal’s Rules of Procedure. The Association requests the right to participate in mediation and/or a hearing of the Application.
8In accordance with the Tribunal’s standard practice where an applicant is represented by an association as the exclusive bargaining agent, the Association’s request to intervene is granted.
9Given that the parties and the Association have indicated a willingness to participate in mediation, the Registrar’s Office will schedule a mediation in this matter.
10I am not seized of this matter.
