DECISION
Adjudicator: Kathleen Martin
Indexed as: Martin v. Anishinaabe Abinoojii Family Services
1This is an Application filed on August 27, 2010 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”).
2On October 26, 2010, the Tribunal issued a Notice of Intent to Dismiss (“Notice”) indicating that it appears that the Application is outside of the Tribunal’s jurisdiction because a review of the Application and the narrative setting out the incidents of alleged discrimination fails to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondent. The Notice indicated that the applicant must provide written submissions responding to the issues identified within 30 days. In addition, the Notice stated that if written submissions were not filed by the required time, the Tribunal will make its decision based only on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss it for that reason.
3The applicant has not filed submissions and the time for responding has elapsed.
4In the absence of any submissions from the applicant, I find that the applicant has abandoned her Application. The Application is therefore dismissed.
Dated at Toronto, this 10th day of December, 2010.
