1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on October 12, 2010.
2On October 27, 2010 the Tribunal issued a Notice of Intent to Dismiss the Application on the basis that the area of the respondent in which the applicant was employed appeared to be a federally regulated business or service and was therefore outside the Tribunal’s jurisdiction. The applicant was directed to provide his submissions on the jurisdictional issue to the Tribunal within 30 days of the date of the Notice and warned that failure to do so could result in dismissal of the Application as abandoned.
3As of the date of this Decision the applicant has not responded to the Tribunal and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
