Health Canada, Minister of Health, Federal Crown Attorney, and Kent St. Law Chambers Respondents
Decision
Adjudicator: Ena Chadha Date: December 7, 2010 Citation: 2010 HRTO 2429 Indexed as: West v. Health Canada
1The applicant filed an Application on June 17, 2010, under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code").
2By correspondence dated October 5, 2010, the Tribunal advised the applicant that, based on a review of the Application and allegations, it appears the Application is outside the Tribunal's jurisdiction. Specifically, it appears that three respondents are federal government departments and/or agencies and, while the fourth may be within provincial jurisdiction, the Application fails to identify any specific acts of discrimination within the meaning of the Code in relation to that fourth respondent.
3The Tribunal directed the applicant to provide written submissions within 30 days from October 5, 2010, as to whether the Tribunal has jurisdiction to proceed with this Application. The applicant was also advised that the Tribunal may consider a failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not responded to the Tribunal's correspondence and the timeline for providing written submissions has elapsed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6Accordingly, the Application is dismissed.
Dated at Toronto, this 7th day of December, 2010.
