1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on September 15, 2009.
2On July 5, 2010 the Tribunal sent the parties a Notice of Mediation scheduling mediation for October 27, 2010. The Notice was sent to the applicant’s address provided in her Application and was not returned to the Tribunal.
3The applicant failed to attend the mediation on the scheduled date and did not contact the Tribunal to seek an adjournment or explain her absences.
4On November 1, 2010 the Tribunal wrote the applicant and directed her to advise the Tribunal of her intentions with respect to the Application within 10 days. The letter went on to advise failure to respond to the letter would result in the Application being deemed abandoned and dismissed for that reason. The applicant did not respond to this letter.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
