1This is an Application filed under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The complaint which underlies the present Application was filed with the Ontario Human Rights Commission on October 9, 2007.
2The applicant is a child. The parties agree that in accordance with the Tribunal's Rules, all decisions regarding these parties should anonymize the name of the applicant and her litigation guardian. I agree.
3The respondent further requests that the names of the respondents be anonymized to ensure that the applicant is not identified. I agree with part of the request. It is reasonably likely the applicant might be identified if the name of the personal respondent is used given the position the personal respondent holds with the organisational respondent. However, I disagree that there is any basis for concern that the applicant could be identified if the organisation respondent, a large metropolitan school board, is identified. The respondents' request is therefore granted in part.
4The parties have also requested that all past decisions be anonymized. The legal reporter services to which the Tribunal distributes its decisions will be advised of this Interim Decision and asked to amend the Interim Decisions previously provided to them to use the anonymized style of cause and "indexed as" line contained on the cover page of this Interim Decision.
