HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Aaron Lowe
Applicant
-and-
Apple One Employment Services
Respondent
DECISION
Adjudicator: Ken Bhattacharjee
Indexed as: Lowe v. Apple One Employment Services
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on August 17, 2010, which alleged that the respondent discriminated against him with respect to employment because of his race, sexual orientation and record of offences, and subjected him to reprisal.
2Specifically, he alleged that he attempted to apply for a job through the respondent, but was refused and told to call another agency. There are no particulars in the Application that explain how the respondent's refusal was related to his race, sexual orientation or record of offences, or how the respondent subjected him to reprisal as defined in the Code.
3On August 31, 2010, the Tribunal's Registrar issued the applicant a letter which informed him that his Application was incomplete, and that he was required to provide the missing information by no later than September 20, 2010. The applicant did not provide the missing information by the due date.
4The letter also contained a Notice of Intent to Dismiss Application if Completed, which informed the applicant that his Application appears to be outside of the Tribunal's jurisdiction. The Tribunal invited the applicant to provide written submissions to explain why the Application is within the Tribunal's jurisdiction by no later than September 30, 2010. The applicant did not provide written submissions by the due date.
5On October 1, 2010, the applicant sent the Tribunal an e-mail, which stated: "I am in agreement with [the Registrar] that my matter is not within the jurisdiction of the HRTO."
6Accordingly, I find that the Tribunal has no jurisdiction over this Application, and it is therefore dismissed.
Dated at Toronto, this 18^th^ day of November, 2010.
