1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"), on May 11, 2010 alleging discrimination in employment on the grounds of association with a person. The Application has not yet been sent to the respondent.
2On August 20, 2010 the Tribunal sent the applicant a Notice of Intent to Dismiss ("NOID"). The NOID stated that it appeared the Application is outside the Tribunal's jurisdiction because a review of the Application and the narrative setting out the incidents of alleged discrimination fail to identify any specific act of discrimination within the meaning of the Code. The Tribunal requested that the applicant file submissions within 30 days addressing how her Application raised allegations pertaining to a violation of the Code and warned that if she did not file submissions, the Tribunal would make its decision based only on the information contained in the Application or may consider the failure to respond as an abandonment of her Application and dismiss the Application for that reason.
3The applicant has not filed any submissions or otherwise communicated with the Tribunal and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application. Accordingly, the Application is dismissed.
