1The applicant has sent a letter asking that the Tribunal proceed with his Application, which was deferred pending the conclusion of grievances filed by the applicant under the collective agreement: see 2010 HRTO 2186. Essentially, the applicant states that he does not have confidence in the grievance and arbitration process or his union.
2The applicant has given no reasons that would justify the Tribunal departing from its usual approach to deferral where there is a grievance outstanding. Where an applicant has made the choice to file a grievance and pursue the grievance process under the collective agreement, the Tribunal deals with the application after the conclusion of that process to avoid duplication of proceedings.
3The applicant’s request is dismissed.
