1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on October 14, 2009 and the respondent filed a Response on December 22, 2010.
2The Tribunal scheduled a mediation session on October 4, 2010. The Notice of mediation was sent to the applicant on May 18, 2010 at the address provided by him in his Application. The Notice was not returned to the Tribunal. The applicant failed to attend the mediation and did not contact the Tribunal to seek an adjournment.
3By letter dated October 21, 2010, the Tribunal asked the applicant to advise it of his intentions with respect to the Application. The letter advised the applicant that if he did not respond within 10 days of the date of the letter, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence and the Tribunal’s letter has not been returned to it.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
