Human Rights Tribunal of Ontario
Between:
R. H. Applicant
-and-
Kawartha Pine Ridge District School Respondent
Interim Decision
Adjudicator: Michelle Flaherty Date: November 3, 2010 Citation: 2010 HRTO 2210 Indexed as: R.H. v. Kawartha Pine Ridge District School
1This Application, filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), raises allegations that the respondents discriminated against the applicant on the basis of disability and sex in the provision of goods, services and facilities.
2The Tribunal issued an earlier Interim Decision, 2010 HRTO 2174 denying a request to dismiss the Application. In the earlier Interim Decision, the Tribunal identified the applicant by his full name.
3The applicant had filed a Response to an Request for an Order During Proceedings on October 9, 2010. In the Response, the applicant asks that he be identified by his initials in order to protect the identify of a minor.
4Because of an administrative error, the Tribunal did not consider the Response at the time it rendered the earlier Interim Decision.
5Rule 3.11.1 of the Tribunal's Rules of Procedure states:
Unless otherwise ordered, the Tribunal will use initials in its decisions to identify children under age 18 and the next friend of children under 18. It may use initials to identify other participants in the proceeding if necessary to protect the identity of children.
6The allegations contained in the Application relate to the fact that the applicant's son is a student with the respondent school board. I accept that it is appropriate to identify the applicant using his initials in order to protect the identify of a minor.
7The style of cause has been amended accordingly. It is also appropriate to amend the style of cause used in the earlier Interim Decision.
8The Tribunal will contact reporting services in order to ensure that Interim Decision, 2010 HRTO 2174, contains the appropriate, anonymized style of cause.
9I am not seized of this matter.
Dated at Toronto, this 3rd day of November, 2010.
