1This is a Complaint relating to the Special Diet Allowance referred to the Tribunal by the Ontario Human Rights Commission under the previous version of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. It is part of the large group of cases addressed in Ball v. Ontario (Community and Social Services), 2010 HRTO 360, and related decisions.
2The complainant is deceased. The Tribunal’s Decision, which was sent to the complainant, has been returned by Canada Post marked “MOVED/UNKNOWN”. The Commission and the respondent have no record of any next of kin for the complainant.
3On October 19, 2010, the Tribunal wrote to the parties indicating that if any of the parties objected to dismissal of the complaint in light of these facts, they should advise the Tribunal by October 29, 2010. None of the parties objected,
