Reasons for Decision

1This is an Application alleging a breach of settlement because of the alleged late payment of settlement monies. By Case Assessment Direction dated April 27, 2010, the Tribunal directed that the hearing would be held by teleconference. On October 4, 2010, a Notice of Conference Call was sent to the parties scheduling the teleconference for November 1, 2010 at 2:00 PM and providing the relevant call-in number. The Notice was sent by mail to the applicant at the address he provided when he filed his Application.

2By 2:30, half an hour after the scheduled starting time, the applicant failed to dial into the conference call. Mr. Nicoletti was present on behalf of the respondent. Accordingly, in accordance with the Tribunal’s standard practice when an applicant fails to attend a hearing, the Application is dismissed as abandoned.
