1The applicant filed an Application on June 18, 2010, under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On July 30, 2010, the Tribunal issued a Notice of Intent to Dismiss to the applicant. The Notice advised the applicant that the Application appeared to be outside the Tribunal’s jurisdiction because the respondent appeared to be a federally regulated government, department, agency or federally regulated business or service. The Tribunal invited the applicant to provide written submissions addressing the issue of jurisdiction.
3On October 1, 2010, the applicant wrote to the Tribunal and advised that the Canadian Human Rights Commission has confirmed that the matter comes within federal jurisdiction. The applicant enclosed a copy of a letter from the Canadian Human Rights Commission.
4Based on the information provided by the applicant, I find that the Tribunal does not have jurisdiction over this Application. Accordingly, the Application is dismissed.
