1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on November 13, 2009 and the respondent filed a Response on February 19, 2010.
2The Tribunal has attempted to schedule a mediation session with the consent of both parties and the proposed intervener CAW Local 555. The applicant has not provided the Tribunal with an available date for mediation.
3By letter dated October 1, 2010, the Tribunal advised the applicant that if she did not respond within 10 days of the date of the letter, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
