1The applicant filed an Application on July 23, 2010 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code"). The Application alleges discrimination in employment because of disability.
2The Application states that the date of the last event is January 20, 2009 when the applicant had a heart attack and was laid off. In the Application the applicant explains "I was laid off, and assumed it was because of lack of work. This wasn't the case. It was because I had a heart attack. I was the only employee laid off."
3The Tribunal sent the applicant a Notice of Intent to Dismiss on the basis the Application was filed more than one year after the last incident of discrimination. The Notice directed the applicant to provide submissions by October 8, 2010 on these issues. The Notice also advised that if the applicant failed to provide submissions the Tribunal may dismiss the Application as abandoned. The applicant has provided no submissions and the time for doing so has passed.
4In the circumstances the Application is dismissed as abandoned.
