INTERIM DECISION
Adjudicator: Ena Chadha
Indexed as: Dai v. Presbytery of East Toronto
1By way of Interim Decision, 2010 HRTO 1730, and Interim Decision, 2010 HRTO 1879, the Tribunal directed the parties to file submissions regarding several preliminary matters arising out of two Applications filed by the applicant.
2All parties have confirmed in writing with the Tribunal that they agree that Application 2010-04470-I and Application 2010-04530-I have overlapping facts and issues and therefore should proceed together. Accordingly, the Tribunal directs that these Applications be consolidated for all future steps in the Tribunal process.
3As noted in an earlier Interim Decision, a related matter is proceeding before the Tribunal by way of a Transition Application (TR-0185-09) and a Case Resolution Conference decision is pending. The Tribunal determines that given that the parties are the same in these proceedings and there may be some related issues, a fair, just and expeditious resolution requires that the current Applications be held in abeyance until the conclusion of the Transition proceeding.
4In the circumstances, the Tribunal will hold this Application in abeyance and take no further steps until contacted by one of the parties advising the Tribunal that the Transition proceeding is concluded. If the Tribunal does not receive a request to proceed with these Applications within six months of the completion of the Transition proceedings, these Applications may be dismissed as abandoned.
5I am not seized of this matter.
Dated at Toronto, this 27th day of October, 2010.
