HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Craig Garlick
Applicant
-and-
Northern Dock Systems Inc. and Kirby Moore
Respondents
DECISION
Adjudicator: David A. Wright
Indexed as: Garlick v. Northern Dock Systems
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The applicant alleges that the respondents committed a reprisal against him contrary to s. 8 of the Code. On August 30, 2010, the Tribunal issued a Notice of Intent to Dismiss stating that it appeared that the Application was outside the Tribunal’s jurisdiction because it did not allege reprisal for asserting Code rights. The Notice stated that the applicant was required to file written submissions responding to the issues identified in the Notice within 30 days, and the Tribunal may consider a failure to respond as an abandonment of the Application.
3The applicant did not respond to the Notice. The Application is dismissed as abandoned.
Dated at Toronto, this 4th day of October, 2010.
