Date: September 30, 2010
Citation: 2010 HRTO 2003
Indexed as: Saftarov v. Ontario (Attorney General)
1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”). The applicant alleges that he was discriminated against by a judge’s decision. On August 20, 2010, the Tribunal issued a Notice of Intent to Dismiss stating that it appeared that the Application was outside the Tribunal’s jurisdiction. The Notice stated that the Tribunal had held that it has no jurisdiction to hear applications against courts and tribunals based on the execution of administrative duties or decision-making because of the doctrine of judicial immunity. The Notice stated that the applicant was required to file written submissions responding to the issues identified in the Notice within 30 days, and the Tribunal may consider a failure to respond as an abandonment of the Application.
2The applicant did not respond to the Notice. The Application is dismissed as abandoned.
Dated at Toronto, this 30^th^ day of September, 2010.
