1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on May 28, 2010. The Application has not yet been served on the respondents.
2By Notice of Intent to Dismiss dated August 4, 2010, the Tribunal noted that the Application appeared to be outside the jurisdiction of the Tribunal and directed the applicant to file submissions that addressed the issue of which good, service or facility the respondents provided to the applicant and how the respondents’ actions constitute discrimination within the meaning of the Code.
3The applicant was informed that if he did not respond within thirty days of the date of the Notice, the Tribunal could deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence and his deadline for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
