Respondent
DECISION
Adjudicator: Michelle Flaherty
Indexed as: MacBain v. Robinson and Associates Insurance
1This Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On February 5, 2010 the Tribunal issued a Notice of Intent to Dismiss (“Notice”) indicating that the Application did not appear to identify any specific acts of discrimination allegedly committed by the individual respondents and within the meaning of the Code. The Tribunal invited submissions from the applicant in this regard and indicated that if the applicant failed to respond to the Notice, the Application may be considered abandoned.
3On March 8, 2010, the Tribunal issued a second Notice indicating that the Application did not appear to allege a ground or area of discrimination under the Code and, as such, does not appear to raise an issue the Tribunal can resolve. Again, the Tribunal invited submissions and indicated that the failure to respond could be considered an abandonment of the Application.
4The applicant has not communicated with the Tribunal or filed submissions in response to either Notice.
5In the circumstances, the Application appears to have been abandoned and is accordingly dismissed.
Dated at Toronto, this 21st day of September, 2010.
