HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Robert Spooner
Applicant
-and-
Northumberland County Social Housing and Corporation of the County of Northumberland
Respondents
INTERIM DECISION
Adjudicator: Naomi Overend
Indexed as: Spooner v. Northumberland County Social Housing ______________________________________________________________________
1This Interim Decision deals with the applicant’s Request for Order to add an additional respondent to his Application. The applicant filed his Application on April 15, 2010 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in housing. Although the original named respondent in the Application was Northumberland County Community and Social Service, the respondent noted that the correct name is Northumberland County Social Housing.
2On August 28, 2010, the applicant brought a Request for Order During Proceedings (Form 10) asking to amend his Application to add the Corporation of the County of Northumberland as a respondent. The applicant sets out the following rationale for his request in his Form 10:
The County of Northumberland has been designated as Service Manager for Social Housing by the Social Housing Reform Act. The Applicant is a tenant in a unit managed by the County of Northumberland. The allegations set out in the Application pertain to the failure of the County of Northumberland’s Housing Services Department’s [sic] to meet the Applicant’s request for accommodation.
3The Request for Order notes that the other parties consent to the request to add this respondent; indeed, no further submissions have been received from either the respondent or the proposed respondent in response to the Request.
4Based on the applicant’s submissions, it would appear that the proposed respondent is a necessary party to this proceeding. Accordingly, I order that the Corporation of the County of Northumberland be added as a respondent to this Application and the style of cause be amended to reflect this addition.
5I am not seized of this matter.
Dated at Toronto, this 20^th^ day of September, 2010.
