Reasons for Decision

1In a previous Interim Decision, 2010 HRTO 1603, the Tribunal deferred this Application pending the conclusion of the proceeding before the College of Physicians and Surgeons. That proceeding has now concluded through the withdrawal of the complaint before that body. The applicant has now filed a Request to proceed under Rule 14.3.

2Although the Request to proceed with this Application was served on the respondent on August 4, 2010, the respondent did not file any response submissions with the Tribunal.

3In the circumstances, the Request to proceed is appropriate and is granted. The Registrar shall schedule the Application for a hearing.

4I am not seized of this matter.
