1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on June 4, 2009, and the respondents filed a Response on July 23, 2009.
2By correspondence dated August 9, 2010, the Tribunal directed the applicant to respond to the respondents’ request to dismiss the Application on the basis that the decision under the Employment Standards Act (“ESA”) has appropriately dealt with the issues in dispute. The Tribunal also directed the applicant to respond to the respondents’ request to defer the Application pending completion of the ESA process.
3The Tribunal advised the applicant that if she did not provide submissions the Tribunal may consider the failure to respond as an abandonment of the Application and dismiss it for that reason. The applicant has not filed written submissions and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
