1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on February 8, 2010 and the respondent filed a Response on July 21, 2010.

2The respondent asked that the Application be dismissed on the basis that another proceeding has appropriately dealt with the substance of the Application. By correspondence dated August 17, 2010, the Tribunal directed the applicant to provide submissions in response to the request to dismiss. The Tribunal advised the applicant that if the applicant did not provide written submissions, the Tribunal may consider that as an abandonment of the Application and dismiss it for that reason. The applicant has not responded to the Tribunal’s correspondence.

3In the circumstances, the applicant is deemed to have abandoned the Application.

4The Application is dismissed.
