1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on April 22, 2010.
2On July 28, 2010, the Tribunal issued a Notice of Intent to Dismiss advising the applicant that the Application appears to be outside the Tribunal’s jurisdiction because of the delay in filing it, and because the applicant has commenced a civil proceeding with respect to the same issues. The Tribunal directed the applicant to provide submissions on these issues, and advised her that it may consider a failure to respond as an abandonment of the Application and dismiss it for that reason.
3The applicant has not responded to the Tribunal’s correspondence and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
