1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on September 23, 2009. As the parties indicated that they agreed to attend mediation, a mediation date was scheduled. The applicant failed to appear at the scheduled mediation on July 6, 2010 and did not otherwise contact the Tribunal.
2By correspondence dated July 15, 2010, the Tribunal informed the applicant that if he did not respond within 10 days of the date of the correspondence to advise the Tribunal of his intentions with respect to the Application, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence.
3In the circumstances, the applicant is deemed to have abandoned the Application.
4The Application is dismissed.
