1This is an Application filed on February 17, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On June 10, 2010, the Tribunal issued a Case Assessment Direction scheduling a one hour conference call for the purpose of hearing submissions on whether or not the Tribunal has jurisdiction to hear the Application.
3On August 18, 2010, the conference call hearing commenced at 9:30 a.m. The applicant did not appear but the respondents were in attendance. The Tribunal waited for one-half hour, received submissions from the respondents and then dismissed the Application. The following are my reasons.
4I am satisfied that the applicant received notice of the conference call hearing. On July 26, 2010, Tribunal staff emailed the parties indicating that, based on the parties’ mutual availability, the conference call would take place on August 18, 2010 at 9:30 a.m. and that confirmation of this information would follow by mail. A Notice of Conference Call was subsequently mailed on August 9, 2010. Both the email and Notice of Conference Call were sent to the applicant at the email address and municipal address provided by the applicant. The Tribunal has previously corresponded with the applicant at the email and address used. Neither the email nor correspondence scheduling the conference call was returned.
5Further, the Tribunal received no request to adjourn the conference call.
6Having regard to the above and the respondents’ submissions, the Application is dismissed as abandoned.
