1In an earlier Interim Decision, 2010 HRTO 1248, the Tribunal sought submissions from the parties with respect to the status of the applicant’s Workplace Safety and Insurance Board (“WSIB”) claim and whether or not it was appropriate to defer this Application pending the conclusion or outcome of that proceeding.
2The applicant advises that there are no objections or outstanding appeals pending with respect to her Workplace Safety and Insurance Board claim and, as such, the applicant opposes the deferral of her Application.
3The respondents indicate that they do not seek the Application be deferred.
4In light of the fact that there is no other legal proceeding, deferral is not appropriate in the circumstances.
5Given that the parties have confirmed a willingness to participate in mediation, the Registrar’s Office will contact the parties in order to schedule a mediation in this matter.
6I am not seized.
