1This is an Application filed on April 21, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination on the basis of race, colour, place of origin, ethnic origin, creed, sex, and family status in employment. The applicant indicated in his Application that he is employed by Hilton Toronto, but named only Edwin Frizzell, who is identified as a General Manager, as a respondent.
2A Notice of Application was delivered to the named respondent on June 22, 2010. On July 26, 2010, Hilton Toronto filed a Request for an Order During Proceedings ("Request"), seeking to add Hilton Toronto and remove Mr. Frizzell as respondents. Hilton Toronto submitted, among other things, that Mr. Frizzell was acting in his capacity as a Hilton employee in regards to all of his alleged actions in the Application and Hilton Toronto will assume liability for any actions of its employees that are proven in the Application. The applicant filed a Response, consenting to Hilton Toronto's Request that it be added as a respondent and that Mr. Frizzell be removed as a respondent to the Application.
3In the circumstances, and in light of the applicant's consent, Hilton Toronto's Request is granted. Hilton Toronto is added and Edwin Frizzell is removed as respondents to the Application, and the style of cause is amended accordingly.
4The applicant also filed a Request that the Tribunal order Hilton Toronto to provide a Response to the Application. Having regard to the Tribunal's Rules of Procedure, Hilton Toronto is directed to file a Response to the Application (in Form 2) not later than 35 days from the date of this Interim Decision.
5I am not seized.
