1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on May 20, 2009. The respondent filed a Response on August 11, 2009. The Application was originally scheduled for mediation on May 17, 2010, but was subsequently rescheduled for July 9, 2010. The applicant did not attend the mediation.
2On July 9, 2010, the applicant emailed the Tribunal and indicated that she had "forgot to switch" the date of the mediation from July 19, 2010 (an earlier date she proposed) to July 9, 2010 and asked what she should do. On July 12, 2010, the Registrar sent a letter to the applicant by regular mail and email indicating that she must advise the Tribunal of her intentions with respect to the Application and outlining what steps she must take to reschedule the mediation. The letter concluded with the following:
If you do not respond within ten days of the date of this letter, the Tribunal will deem you to have abandoned the Application and close this file.
3To date, the applicant has not responded to the letter or otherwise communicated with the Tribunal.
4In the circumstances, the applicant is deemed to have abandoned the Application. Accordingly, the Application is dismissed.
