1The applicant filed an Application under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code") on January 4, 2010. The respondents filed a Response on May 20, 2010. The applicant filed a Reply on June 9, 2010.
2On July 9, 2010, the Tribunal wrote to the parties and advised that, based on a review of the Application, Response and Reply; it appears that a related matter is proceeding before the Tribunal by way of a Transition Application and that a Case Resolution Conference decision is pending. The Tribunal invited the parties to file submissions within 14 days of July 9, 2010, regarding whether or not the current Application should be held in abeyance until the conclusion of the Transition proceeding.
3On July 22, 2010, the respondents filed submissions stating that they believe this Application should be held in abeyance due to the overlapping facts and issues. The applicant filed submissions on July 23, 2010, indicating that he does not object to the Tribunal holding this Application in abeyance.
4In the circumstances, the Tribunal will hold this Application in abeyance and take no further steps until contacted by one of the parties advising the Tribunal that the Transition proceeding is concluded. If the Tribunal does not receive a request to proceed with the Application within six months of the completion of the Transition proceedings, this Application may be dismissed as abandoned.
