1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on November 4, 2009 alleging discrimination in employment.

2Following delivery of the Application to the respondent, the Tribunal received a Response in which the respondent requested that the Application be dismissed in its entirety.

3The respondent stated that it is an Ontario corporation that operates as a charter bus business, primarily within Ontario but also extra-provincially. It further stated that it is a federally regulated employer as defined and set forth under the Canada Labour Code, R.S.C., 1985, c. L-2, whose business is one of road transportation that involves crossing provincial or international borders. It noted that the Canadian Human Rights Commission has taken jurisdiction over complaints against it.

4Although the Response had been served on the applicant, no Reply had yet been received. The applicant was directed to file submissions on the respondent’s request to dismiss within 21 days of a Case Assessment Direction issued on June 10, 2010, failing which the Tribunal would either decide the Request on the basis of materials before it or dismiss the Application as abandoned.

5The applicant has not filed any submissions and the time for doing so has elapsed.

6The Application is dismissed as abandoned.
