1The applicant filed this Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 (the “Code”) on July 9, 2009. The applicant alleges that the respondent discriminated against him in employment on the ground of disability. The applicant wrote to the Tribunal on October 23, 2009 to advise that he would like to withdraw his Application immediately. This letter was not sent to the respondent.
2By letter dated November 6, 2009, the Registrar of the Tribunal asked the applicant to deliver to the respondent and file with the Tribunal a Request to Withdraw (Form 9) and a Statement of Delivery (Form 23), providing proof of service of the Form 9, by November 16, 2009. The applicant was advised in this letter that, alternately, if he wished to continue with his Application to notify the Tribunal by November 16, 2009.
3The applicant has not filed a Request to Withdraw, nor otherwise communicated with the Tribunal in response to its November 6, 2009 letter. In the circumstances, it is clear that the applicant no longer wishes to proceed with his Application. This Application is dismissed as abandoned.
