The applicant, a Black man originally from Uganda, alleged that his employer discriminated against and harassed him on the basis of race, colour, ancestry, place of origin, ethnic origin, and age. The Tribunal found that while the employer had legitimate concerns about the applicant's work performance, his manager's decision to issue a warning notice and terminate his employment was tainted by racial discrimination. Specifically, the manager developed an extreme and irrational fear of the applicant based on stereotypes of Black African men being threatening and violent. The Tribunal awarded the applicant $10,000 for injury to dignity, feelings, and self-respect, and ordered the employer to provide human rights training to its managers.
